Terms and Conditions of Use

These Terms and Conditions (the "Terms") govern your access to and use of the Sabero platform, operated by Desarrollo De Software De Colombia S.A.S. By registering, ticking the acceptance box, or using the platform, you declare that you have read, understood, and accepted these Terms in full, as well as our Personal Data Processing Policy. If you do not agree, please refrain from using the service.

Acceptance of the terms

By creating an account, ticking the acceptance box during sign-up, or using any feature of Sabero, you express your express and informed consent to these Terms and to the Personal Data Processing Policy. If you are a minor, your acceptance must be supported by your legal representative as described in the "Eligibility and minors" section. Continued use of the platform after we publish modifications constitutes acceptance of the then-current version.

Identification of the service provider

The Sabero service is operated by DESARROLLO DE SOFTWARE DE COLOMBIA S.A.S., a commercial company incorporated under the laws of the Republic of Colombia, registered with Tax ID (NIT) 901.241.856-1, with its principal domicile in the city of Bucaramanga, Santander, Colombia. The official contact channel for legal, contractual, and privacy matters is the email privacidad@sabero.co. For the purposes of these Terms, any reference to "Sabero", "we", "us" or "the platform" refers to this company.

Description of the service

Sabero is an online platform for preparation for higher-education admission exams, with emphasis on the Saber 11 exam and other university entrance tests. The service includes, among others: timed mock exams and practice tests; a standardized question bank; AI-generated question variations; an AI Tutor providing step-by-step help per question; a personal AI Coach that recommends exams and guides your study plan; AI-generated explanations; flashcards with spaced repetition; a custom exam builder by subject, difficulty, and filters; complete attempt history and progress tracking; score estimates based on Item Response Theory (IRT); and detailed analytics by subject. Sabero is an educational support tool and does not replace formal education or the official preparation provided by ICFES or any higher-education institution. We do not guarantee any specific score, result, or admission on any exam.

Eligibility and minors

Sabero is primarily aimed at students preparing for the Saber 11 exam and university admission tests, a group that mostly includes minors. If you are under eighteen (18) years of age, by creating an account you declare that you have the prior, express, and informed authorization of your father, mother, or legal representative, both to use the platform and for the processing of your personal data under article 12 of Decree 1377 of 2013. The legal representative will be responsible for the minor's use of the platform and any payments made therein. We may request evidence of such authorization at any time and suspend accounts when it cannot be evidenced. Minors' personal data receives enhanced treatment under our Personal Data Processing Policy.

Account registration and responsibilities

To use certain features you must register with truthful, complete, and up-to-date information, including name, email, and password. You are responsible for the confidentiality of your password, for activities carried out under your account, and for notifying us immediately of any unauthorized access by writing to privacidad@sabero.co. Each person must keep a single account; you may not assign, lend, share, or sell it to third parties. We reserve the right to suspend accounts with false, duplicate information, or evidence of shared or automated use.

Acceptable use

You agree to use Sabero exclusively for lawful, educational purposes. The following is prohibited: (i) using automated systems (bots, scrapers, crawlers) to access the platform or extract content without authorization; (ii) attempting to circumvent security measures, usage limits, or access controls; (iii) impersonating another person or entity; (iv) using the service to commit academic fraud or unlawful activities; (v) uploading or transmitting illegal, offensive content, content infringing third-party rights, or malicious code; (vi) reverse engineering, decompiling, or attempting to extract the platform's source code; and (vii) commercializing or publishing outside the platform AI-generated answers as if they were your own content. Non-compliance may result in immediate suspension or termination of the service, without prejudice to any applicable legal actions.

Intellectual property and content

The Sabero platform, its source code, design, trademarks, logos, databases, questions, explanations, flashcards, and other content are the exclusive property of Desarrollo De Software De Colombia S.A.S. or its licensors, and are protected by Colombian Law 23 of 1982 on copyright, Decision 486 of 2000 of the Andean Community on industrial property, and other applicable rules. You are granted a limited, personal, non-transferable, non-exclusive, and revocable license to access and use the service strictly for educational and non-commercial purposes. You may not copy, reproduce, distribute, publicly communicate, modify, or commercially exploit the platform's content outside of it without prior written authorization.

AI-generated content

Sabero uses artificial intelligence to provide the AI Tutor, AI Coach, question variations, explanations, and flashcards. AI-generated content is educational and orientational only; it may contain inaccuracies, omissions, or errors. It does not constitute professional advice nor official information from ICFES or any educational institution. You are responsible for verifying and cross-checking relevant information before relying on it for academic decisions. To operate these features, your queries may be processed by external technology providers under our Personal Data Processing Policy. We may set reasonable usage limits, quotas, or restrictions to ensure service availability and quality.

Privacy and personal data processing

The use of Sabero is also governed by our Personal Data Processing Policy, which describes what data we collect, for what purposes, with whom we share it, how we protect it, and how you can exercise your habeas data rights under Colombian Statutory Law 1581 of 2012 and Decree 1377 of 2013. By accepting these Terms, you also grant your prior, express, and informed authorization for the processing of your personal data as described therein.

Plans, prices and billing

Sabero offers free plans with limited features and paid plans with extended features. Current prices, the currency (Colombian pesos, COP) and the duration of each plan are published in the membership section. Payments are processed through payment gateways authorized in Colombia (e.g. Wompi), via credit card, PSE, Nequi, Daviplata, or other available means. When you purchase a plan, you authorize the corresponding charge and the issuance of an electronic invoice to the billing information you provide. Applicable taxes (VAT where applicable) are included or added as indicated in the purchase summary. We may modify prices and plans with reasonable prior notice; changes will not affect memberships already paid for during their validity period.

Right of withdrawal

Pursuant to article 47 of Colombian Law 1480 of 2011 (Consumer Statute), as this is a distance contract, you have the right to withdraw from the purchase of a paid plan within five (5) business days following the transaction date, provided you have not made substantial use of the plan or consumed its main benefits (e.g. intensive use of the AI Tutor or massive access to exclusive content). To exercise this right, write to privacidad@sabero.co indicating your full name, registered email, and transaction number. The refund will be made through the same payment method within thirty (30) calendar days following the request, as required by the cited rule.

Refunds and payment reversal

Notwithstanding the right of withdrawal, you may request the reversal of the payment in the cases provided for in article 51 of Law 1480 of 2011 and Decree 587 of 2016, when: (i) you are the subject of fraud; (ii) the transaction corresponds to impersonation; (iii) you have not received the service; or (iv) the service delivered does not match what was requested or is defective. The request must be submitted within five (5) business days following knowledge of the event, simultaneously to Sabero (privacidad@sabero.co) and to the issuer of the payment method. We will assess each case and, where applicable, process the reversal in accordance with applicable regulations.

Termination and suspension

We may suspend or terminate your account and access to the service, in whole or in part, temporarily or permanently, when: (i) you breach these Terms; (ii) there are indications of fraud, impersonation, or abusive use; (iii) it is required by a competent authority; or (iv) there are justified technical or operational reasons. You may close your account at any time from your profile settings or by writing to privacidad@sabero.co. Termination does not affect previously accrued obligations (e.g. pending payments), and we may retain data as set out in the Personal Data Processing Policy and applicable law.

Disclaimers

The service is provided "as is" and "as available". While we strive to keep the platform operational, accurate, and error-free, we do not guarantee uninterrupted availability, absence of failures, or that content (including AI-generated content) is error-free. Sabero is an educational support tool and does not guarantee any score, outcome, or admission on any exam or institution. The platform does not replace the professional judgment of teachers, educational psychologists, or other professionals where appropriate.

Limitation of liability

To the maximum extent permitted by Colombian law, Desarrollo De Software De Colombia S.A.S. and its directors, employees, and affiliates shall not be liable for indirect, incidental, special, consequential damages, or lost profits arising from or in connection with the use or inability to use the service. The total aggregate liability for any claim shall not exceed the greater of (a) the amount actually paid by the user in the twelve (12) months prior to the triggering event, and (b) one hundred thousand Colombian pesos (COP 100,000). Nothing in this clause limits liabilities that, under the law, cannot be waived (e.g. willful misconduct or gross negligence).

Changes to the terms

We may modify these Terms to reflect changes in the service, legal requirements, or best practices. We will publish the updated version on the platform and update the "Last updated" date. When changes are substantial, we will notify you at least fifteen (15) calendar days in advance by email or in-product notice. If you disagree with the changes, you may close your account before the effective date; continued use of the service after that date implies acceptance of the new version.

Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Colombia. Any controversy arising from their interpretation, execution, or compliance shall be submitted to the jurisdiction of the competent Colombian courts, in particular those of the consumer's domicile when so provided by the Consumer Statute, unless the parties agree on an alternative dispute resolution mechanism.
